did you buy it at a store or over the internet? - If it was a store, I would take it back and insist they adjust it.
could also be a bridge thats to low - raise the bridge

A bad connection at the jack is a possibility, with passives a bad connection will usually yeild no sound or a lot of crackling,

From the neck stamps I think its a Fender japan body.
The string tree is the wrong type and in the wrong place. for an esp. The logo is not the correct ESP logo for the lawsuit headstock.
